This Privacy Policy describes how BeneVita (“BeneVita”, “we”, “our”, “us”) may collect, use, and disclose personal information of visitors who access or interact with our mobile application (“App”) or our websites (“Websites”) that link to this Privacy Policy, as well as other personal information about our customers.  The App, those Websites, and our related service offerings are referred to in this Privacy Policy as our “Services.” If you provide personal information to us relating to other individuals, you are responsible for communicating the terms of this policy to them. Please note, our Services are intended only for use by adults in the United States.

How we collect Personal Information

We may collect personal information directly from you, from third parties or publicly available data, or automatically when you use the Services through the use of technologies such as electronic communication protocols, cookies, widget buttons, or tools. We may also use third-party web and mobile app analytics services to help us understand and analyze how visitors use the online Services.  Please check your browser and device settings to control the location data you allow your browser and device to collect and share with third parties.

We collect this personal data for the purposes outlined below in “How We Use Personal Data.” The types of personal information we collect about you depends on your relationship with us and may include:

  • Anything contained in records and your related communications with others via the platform related to medical conditions, such as diagnosis and treatment data, prescription information, biometric data, gender, and anything else in the records you choose to upload, link or share (your “Medical Records”). 

  • Identification and background information used to create accounts or to enable our users of our Services to communicate with you, including your contact details.

  • Financial Information, such as bank account or credit card details used to pay for our Services.

  • Technical information, such as your IP address, device characteristics (including device identifiers), web browser characteristics, unique identifiers and other data stored in cookies, operating system details, language preference, referring URLs, length of visits, pages viewed, and other information that may be automatically accessible to us from your browser or device.

  • Personal information of other people you choose to share on or via the BeneVita platform, such as contact details, name and types of medical providers, caregivers and other people.

  • Content of any feedback, inquiries or other communications with us.

  • Any information you choose to share when using the Services.

 

How we use your Personal Information

We may use your personal information for the following purposes:

  • To provide our Services to you and to improve our Services.

  • To conduct statistical analysis of our Services and business operations.

  • To communicate with you about our Services and any third-party offerings or opportunities we may facilitate for you. We may communicate to you via in-app messages, emails, push notifications and other SMS/text messages. Message and data rates may apply.

  • For any other lawful purpose, with your consent where appropriate.

  • BeneVita generally will not know what information is contained in and does not access, analyze or otherwise process your Medical Records except to provide the Services. We may access, use and analyze technical information about your Medical Records, such as file type and other information about your use of our Services such as recipient and sender information if you transmit Medical Records via the Services.  If or when you choose to categorize your Medical Records (for example, X-Rays, lab reports, etc.) we will know the label you ascribe but not the contents of the Medical Records themselves.  Except where required by law to do otherwise, we rely on your consent for any Services we offer now or in the future that require or allow us to access or process health related data contained Medical Records.

 

Sharing your Personal Information

We may share your personal information as follows:

  • With any person or entity you give access to your account.

  • When you direct us to do so in order to provide the Services, such as your voluntary sharing of Medical Records with or communicating with a third party.

  • With vendors who assist us with offering the Services or as otherwise described in this Privacy Policy, such as analytics providers, marketing and advertising services, providers of payment services, providers of other support for our transactions (e.g., accounting services), and providers of technical services (e.g., data ).  When our vendors’ cookies run on our Services they may collect identifiers such as your IP address, Cookie ID, Device ID, and Pixel ID, network activity information such as HTTP header information, button click data, referring website activity, and location data.

  • In the event of a business transaction, such as if we sell or transfer all or a portion of our business or assets, we reserve the right to disclose any information we obtain through the Services. You acknowledge that such transfers may occur and are permitted by this Privacy Policy.  To the extent legally permitted, the acquiring party may use the information pursuant to their own privacy policy instead of this one.

  • When required by subpoena, search warrant, other legal process, governmental request, where appropriate in response to activities that are unlawful or a violation of our terms of service.

 

Children’s Privacy

Our Services are not intended for, and are not intentionally targeted to minors, and we do not knowingly request or seek to collect personal information from minors.

 

How we keep your information secure

BeneVita seeks to use reasonable administrative, technical and physical safeguards and other security measures to protect personal information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us. Retaining your Personal Information

We retain your personal information for as long as needed to provide the Services or as permitted in light of the purpose(s) for which it was collected and consistent with applicable law.
